These Terms & Conditions ("Terms") govern your access to and use of the MBS Ebooks website and the ebooks and digital content we sell (the "Service"). By using the Service or purchasing an ebook, you agree to these Terms. If you do not agree, do not use the Service.
1. Who we are
The Service is operated by MBS Ebooks ("we", "us", "our"). You can reach us at support@mbsebookmarketplace.com. When you purchase from us, your contract for the Service is with MBS Ebooks.
2. Eligibility and account
You must be of legal age to form a binding contract in your country, or have the permission of a parent or guardian. If you create an account, you are responsible for keeping your credentials confidential and for activity that takes place under your account. You agree to provide accurate information and keep it up to date.
3. The Service
We sell digital ebooks in formats such as EPUB and PDF. After a successful purchase, we make the file available for download via a secure, time-limited link. You may also receive a copy of that link by email. Each ebook is licensed to you for personal, non-commercial use; ownership of the underlying work and the Service remains with us or our licensors.
4. Payment and billing
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax and refund mechanics are governed by Paddle's Checkout Buyer Terms.
5. Licence and restrictions
Subject to your payment, we grant you a limited, non-exclusive, non-transferable right to download and read the ebook for your personal use. You may not:
- resell, sublicense, rent, lend, or otherwise distribute the ebook;
- remove or alter any copyright, trademark, or attribution notices;
- upload the ebook to file-sharing services or otherwise make it available to the public; or
- circumvent any technical limitations or use the ebook to train machine-learning models without our prior written consent.
6. Acceptable use
You must use the Service lawfully and respectfully. The following activities and content are strictly prohibited, and engaging in them may result in immediate suspension or termination of your access, cancellation of orders, and reporting to the relevant authorities:
- any unlawful, fraudulent, deceptive, or harmful activity, including money laundering, tax evasion, or the sale of stolen goods;
- sending spam, phishing, chain letters, or other unsolicited communications;
- infringing the intellectual property rights of others, including copyright, trademark, trade secret, or moral rights;
- uploading, distributing, or creating content that is defamatory, harassing, hateful, threatening, sexually explicit involving minors, or that incites violence or discrimination;
- using the Service to develop, distribute, or promote malware, ransomware, spyware, or any other malicious code;
- probing, scanning, scraping, reverse-engineering, or otherwise interfering with the security or integrity of the Service or attempting to gain unauthorised access to accounts, systems, or data;
- activities prohibited by Paddle's Acceptable Use Policy, including the sale of regulated or restricted goods (firearms, controlled substances, adult content, gambling services, multi-level marketing schemes, counterfeit items, or any product Paddle does not support); and
- impersonating any person or entity or misrepresenting your affiliation with a person or entity.
We reserve the right, at our sole discretion, to investigate suspected violations, remove or restrict content, refuse service, and cooperate with law-enforcement authorities. Repeated or serious violations will result in permanent termination without refund.
7. Intellectual property
All content on the Service — including the software, website design, branding, and the ebooks themselves — is owned by MBS Ebooks or our licensors and is protected by copyright and other intellectual property laws. Nothing in these Terms transfers ownership of any of that content to you.
8. Service level
We aim to keep the Service available and our download links working, but we do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. To the fullest extent permitted by law, the Service is provided "as is" without any implied warranties of merchantability or fitness for a particular purpose.
9. Suspension and termination
We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay amounts due, present a security or fraud risk, or repeatedly or seriously violate our policies. Where it is reasonable to do so, we will give you notice and an opportunity to fix the issue first. Sections that by their nature should survive termination (including licence restrictions and intellectual property) will continue to apply.
10. Liability
To the maximum extent permitted by law, our aggregate liability to you for any claim arising out of or in connection with the Service is limited to the amount you paid us in the twelve months before the claim arose. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be limited under applicable law (such as for fraud, death, or personal injury caused by negligence).
11. Changes
We may update these Terms from time to time. If we make a material change, we will update the "Last updated" date above and, where appropriate, notify you by email or in the Service.
